  • Relief to SIMS employees from High Court, ban on unilateral discharge from work, permission given to work

Virendra Gahwai, Bilaspur. The High Court has given a big relief to the petitioners in the case of unilateral discharge of nurses and other employees of SIMS. The court has directed them to remain employed in SIMS and mark their attendance, as well as issue a notice to the government and reply.

In fact, SIMS employees Geeta Haldar, Damyanti Kashyap, Sharda Yadav, and V Lakshmi Rao have been serving here since before 2001. At the time of establishment of SIMS in 2001, they were considered to be on deputation to Guru Ghasidas University, while their intention was not asked. In 2006, SIMS was again taken over by the government and the services of the petitioners were again given on deputation to the Director, Medical Education. Since then, the petitioners have been continuously serving in SIMS.

Let us tell you that on 28 June 2024, the SIMS administration suddenly relieved the petitioners from duty and ordered them to take charge in the office of the Chief Medical and Health Officer. On the other hand, the Chief Medical and Health Officer refused to give joining to these employees on the ground that he has not received any such order from the government.

Aggrieved by this order, the employees filed a petition in the High Court. In the petition, they alleged that the SIMS administration has not followed the service law and without knowing their intention, they were ordered to be transferred from one department to another, which is against the fundamental rules and is a violation of the constitutional rights of the employees. The High Court has issued a notice to the government and asked it to respond, directing the petitioners to remain employed in SIMS and mark their attendance.

  • The administration did not give permission to the proposed Shiv Mahapuran Katha event, gave this reason while rejecting the application

Raipur. The administration has not given permission for the Shiv Mahapuran Katha program of Pt. Pradeep Mishra proposed in Lormi of Mungeli district. The organizing committee had sought permission for the program, but the Lormi SDM has expressed disagreement and rejected it. The reason given behind this is that adequate arrangements were not made by the organizing committee, although the preparations of the organizing committee were going on in the meantime. The local administration had sought opinion from 6 departments for this. This decision has been given by the administration after receiving objections on this. This program was proposed in Lormi from 2 to 8 August. Chairman Anil Saluja had sought permission on behalf of the committee.

    The administration gave this argument

Anil Saluja, Organising President, Lormi Youth Mandal, District Mungeli, has argued on these points while rejecting the application for granting permission to organise Shiv Katha Mahapuran.

Executive Engineer, Public Works Department has clarified in the opinion letter that

    (a) The area of the meeting place is 4 acres, in which 4×43560 (174240 sq. ft.)/ 6.00 (total 29040.00 persons) can sit. About 1.50-2.00 lakh persons are expected to come daily. The proposed place is inadequate and very less for such a large gathering of people.

    (B) The proposed event venue has been temporarily built by filling fields with soft soil. Adequate compaction has not been done. The self weight of the large dome is very high and hence there is a possibility of the dome collapsing, which may lead to loss of life and unpleasant situation.

    (c) Due to lack of adequate drainage system, there is a possibility of waterlogging in the dome area. There is a possibility of mud and stampede in the meeting place.

    (d) The meeting place is located on the Kota-Lormi Pandariya road SH-10, due to which the state highway cannot be blocked without the permission of the competent authority.

    (E) The meeting place does not have sufficient entry and exit gates for VVIPs, VIPs and the general public. Due to the above reasons, the said meeting place is not suitable for the event.

    Statement from the electricity department

Assistant Engineer (Operation/Commandation) Sub Division Lormi Chhattisgarh State Power Distribution Company has sent its opinion and clarified that it is not appropriate to grant permission for the program during rainy season keeping in mind the planting of Kharif crops and storm, lightning and all other points. This opinion has been given.

    police opinion

Deputy Superintendent of Police, Lormi, has clarified in his letter that in the absence of consent from both the major technical departments, it is not appropriate to grant permission to the organizers from the point of view of security arrangements. Opinion has been given.

what did the health department say

Block Medical Officer, Community Health Center, Lormi has sent a letter clarifying that

    (a) 30 to 40 thousand devotees will spend the night in the pandal itself. Sleeping on carpet on wet soil during rains is likely to have adverse effect on their health.

    (B) Falciparum malaria cases are being reported in Lormi area. There is a risk of malaria if one sleeps without protection.

    (c) There is a danger of diarrhoea at this time.

    (d) The medical human resource available in Lormi is not adequate.

The Public Health Engineering Department said

Assistant Engineer, Public Health Engineering Sub Division Lormi has sent an opinion letter and clarified that due to the arrival of a large number of devotees together during the rainy season, there is a possibility of various water-related diseases such as diarrhea, cholera, water-borne diseases. Keeping in view the very short time for preparations and the possibility of loss of life due to water-borne diseases caused by contaminated drinking water due to rain, it is not possible to provide arrangements for the program.

    The city administration said

Chief Municipal Officer, Nagar Palika Parishad, Lormi has sent a letter clarifying that it is the rainy season and there is no provision for drainage of water at the event venue. There is a possibility of water logging on the roadside, which will disrupt traffic. Lakhs of devotees will come every day and stay overnight. There is not enough arrangement in the municipal area for their bathing, defecation etc. There is a possibility of open defecation and the municipality does not have a system for waste management of mobile toilets. There is a possibility of spread of dirt, foul smell and disease due to the absence of arrangement for systematic and safe disposal of excreta and it being the rainy season. It does not seem appropriate to give permission for the proposed event. Opinion has been presented.

Decision of SDM Lormi based on opinion

Various departments have sent their opinions and expressed their disagreement to organize the proposed program, clearly stating the possibility of danger to public facilities, public health, public safety and public life. This is the reason that it is not possible to grant permission to organize Shiv Katha Mahapuran from 2 to 8 August in Lormi city as per the referenced application submitted on the same grounds. Saying this, Lormi SDM has rejected the applicant’s application. This means that the local administration has refused to give permission for the program.
