Navdeep Thakur was transferred from Dhamtari to Mahasamund under the order issued by IG Raipur, against which he filed a petition in the High Court.

    The petition stated that his wife Digeshwari Dhruv is 6 months pregnant and the expected date of delivery is three months later. There is no other member in the family to take care of his pregnant wife, and in case of transfer, he will not be able to take care of her. Keeping these circumstances in mind, the court stayed the transfer order.

  • Lizard in mid-day meal: DEO suspended the head teacher of Pipalkhunta school, FIR will be filed against the women’s group preparing mid-day meal, more than 25 children fell ill after finding lizard in the lentils

  • High court canceled the special committee of Nagar Panchayat Barela, gave instructions to the present Panchayat officials to work

The court has dissolved the special committee formed for the functioning of Nagar Panchayat Barela. After hearing the case, the court has directed that the current Panchayat officials will continue to work until the newly elected Nagar Panchayat is formed. The case was heard in the single bench of Justice Parth Pratim Sahu.

    The Chhattisgarh Government’s Urban Administration and Development Department, using the powers of Section 5 of the Municipality Act 1961, constituted Gram Panchayat Barela as a Nagar Panchayat through a notification published in the Gazette in 2023 and also notified a special committee for the functioning of the newly constituted Nagar Panchayat. In this, people of the ruling party were included in place of the elected Panchayat representatives, while the tenure of the previously elected public representatives is till February 2025.

    Regarding this, Panchayat representatives Krishna Kumar Yadav, Kritika Dhuri Vasudev Patel and others challenged it in the High Court. It was said that the CMO was appointed as per Section 5 Municipality Act 1961, in this Act there is a provision that till the new council is duly constituted, the already elected representatives will continue to work. During the hearing of the case, the court said that on 27 June 2024, the government has issued a notification going against the Act. The court, while cancelling the special committee, issued instructions to the current Panchayat officials to continue working till the formation of the newly elected Nagar Panchayat.

After hearing the petition, the High Court stayed the order of the state government and issued an order to post the petitioner in his former district.     Actually, Kavita Chincholkar of Mahasamund was posted as an accountant in the Finance Department. On August 16, 2024, she was transferred from Mahasamund to Kanker district. Kavita Chincholkar filed a writ petition in the High Court against the order of the state government. During the hearing of the case, the court was told that the age of the petitioner is currently 61 years and 7 months and on January 31, 2025, she will retire after completing the age of 62 years. If the petitioner is transferred to Kanker district, and she joins there, then she will have to face many difficulties at her age. Apart from this, if she does duty there, then after retirement she will be delayed in getting pension, gratuity, leave encashment and other amounts.

    In a circular issued by the General Administration Department, Raipur, it is said that women government employees above the age of 55 years will not be posted in scheduled and Naxal-affected districts. Despite this, departmental officers violated the government’s instructions to post the petitioner Kavita Chincholkar in Kanker. After hearing the case, the court has cancelled the transfer order and issued an order to post the petitioner in Mahasamund.

    In fact, the Chief Executive Officer of the District Cooperative Central Bank, Surendra Kumar Joshi, had applied for the Ahiwara assembly election in the Block Congress Committee during the assembly elections. After this, a complaint was made to the Collector and the Chief Electoral Office in Delhi regarding his application. On the basis of the complaint, the investigation of the case started in April. Under the Chhattisgarh Civil Services Classification Rule 1961, the Collector constituted an inquiry committee. The inquiry committee included the District Panchayat CEO, Janpad Panchayat CEO and Durg Municipal Corporation Commissioner. The committee recommended suspension on the basis of the application. On April 30, the Collector submitted the report to the Secretary of the Cooperative Department. The Secretary sent the report to the General Manager of the Apex Bank, after which the General Manager suspended him.

    After this, through advocate Shailendra Bajpai, Surendra Kumar Joshi filed a petition in the High Court challenging this suspension order. The petition said that since Surendra Kumar Joshi is also a General Manager level officer and is posted in the district, he is the Chief Executive Officer. His suspension order can be issued either by the Chairman or the Registrar of the Cooperative Society. But without his permission, the General Manager issued the suspension order. The petition was filed on 5 May 2024. The petition was kept reserved during the hearing on 5 August. Hearing on this today, the bench of Justice Sachin Singh Rajput of the High Court, after hearing all the parties, canceled the suspension order of the General Manager.

The CMOs of urban bodies, CEOs of Janpad Panchayat, medical officers, Mitanins and Swachhata Didis were instructed to work with full vigilance and promptness to prevent the impact of diarrhea. The SDM was also asked to hold regular meetings of medical officers and make a better action plan for the prevention of diarrhea.
