Allahabad HC orders CBI inquiry in opposition to 35 police personnel for lodging ‘false circumstances’ in opposition to members of Dalit household

PRAYAGRAJ: The Allahabad High Court has ordered a CBI probe in opposition to 35 police personnel for allegedly lodging false circumstances in opposition to members of a Dalit household in Mathura district.

Justices Suneet Kumar and Syed Waiz Mian handed the order on a writ petition filed by Sumit Kumar and his brother Puneet Kumar.

The duo sought quashing of an FIR lodged on March 24 underneath part 363, 366 IPC at Police Station Rasoolpur in Firozabad and switch of the investigation to the CBI.

Section 363 of the IPC pertains to punishment for kidnapping whereas Section 366 is worried with kidnapping, abducting or inducing a girl to compel her marriage, and so forth It is alleged within the petition that police officers of Mathura district lodged numerous fraudulent and false circumstances, both in opposition to the petitioner or his brother to strain them to agree on a compromise in different circumstances.

In an order handed on September 6, the courtroom noticed, “It is evident that the police personnel of District Mathura have been stage managing to lodge false cases against the family members of the petitioner of which notice has been taken by the National Human Rights Commission and SC Commission.”

A grievance was lodged by Puneet’s mom Maya Devi to the police. The police officers, as an alternative of lodging an FIR, allegedly booked Puneet’s brother Sumit. Maya Devi then moved courtroom, which ordered lodging of an FIR within the October 2013 incident. On the courtroom’s order, police registered an FIR at Police Station Highway, district Mathura.

It is alleged that police officers in connivance with the accused lodged false FIR in opposition to petitioners and their mom at PS Highway.

The mom of the petitioners, aggrieved by the conduct of the police, approached the National Human Rights Commission, New Delhi.

On the instructions of the Commission, a case was registered at PS Highway, District Mathura, in opposition to Surendra Singh Yadav, SHO, and Sub-Inspector Netrapal Singh.

It is additional alleged that on January 10, 2018 Puneet Kumar together with one auto driver was taken into custody by police Special Operation Group (SOG) personnel and was later launched.

The petitioners approached the National Commission for Schedule Castes, UP Lucknow and it directed a particular enquiry cell to probe the matter.
