Compensation amount will be given for loss/damage caused by crime under Jharkhand Victim Compensation Scheme 2016
Application can be made to the District Legal Services Authority for compensation
The Jharkhand government has made a provision for payment of appropriate compensation to victims or dependents for any loss or damage caused by any kind of crime under the Jharkhand Victim Compensation Scheme 2016. For this, the victim or their dependent is to be paid a minimum amount.
Minimum amount fixed on loss or damage due to crime
For various types of crimes such as acid attack, the minimum compensation amount for injury or damage is Rs 3 lakh, while for rape also a compensation amount of Rs 3 lakh is provided, whereas for sexual abuse of minors Rs 2 lakh, for rehabilitation of victims of human trafficking Rs 1 lakh, for sexual harassment (not rape) Rs 50 thousand, for death in any crime Rs 2 lakh, for permanent disability (80 percent or more) Rs 2 lakh, for partial disability (40 percent to 80 percent) Rs 1 lakh, for burning more than 25 percent of the body (excluding acid attack) Rs 2 lakh, for loss of fetus Rs 50 thousand, for loss of reproductive capacity Rs 1.5 lakh, for permanent disability (80 percent or more) or death of a woman victim of cross-border firing Rs 2 lakh and for partial disability (40 percent or more) Rs 1 lakh compensation amount has been provided. Also, in case of loss of any part or organ of the body in any crime resulting in disability less than 40 percent, Rs 50 thousand, for simple loss or damage to a child victim Rs 10 thousand, and Rs 50 thousand for rehabilitation of any other victim has been provided.
Determination of compensation amount
The compensation amount has been determined by the District Legal Services Authority based on the minimum amount required for rehabilitation, including incidental expenses such as loss or damage suffered by the victim, expenses incurred on treatment, and funeral expenses.
Application can be made to the District Legal Services Authority for compensation under the Jharkhand Victim Compensation Scheme 2016.
The scheme also provides that if the victim is less than 14 years of age, the compensation amount can be increased by 50 percent over the specified amount.
