The Kerala High Court has issued a directive preventing the use of artificial intelligence (AI) tools in its judicial processes, including issuing orders. This action is accompanied by detailed instructions to judicial officers and other parties, reflecting concerns about the reliability and potential misuse of AI in legal decision-making. The court has forbidden the use of cloud-based AI tools like ChatGPT for issuing orders, and strict penalties will be imposed for any breaches of this instruction. Additionally, the court has stated that AI should not be used in the formulation of judgments or in reaching conclusions. The High Court has emphasized the importance of caution in the utilization of AI, highlighting the possibility of errors. The court is recommending proper training, available through the Judicial Academy or the High Court, to ensure the correct use of approved AI tools. It has also mandated monitoring at every stage of AI use, requiring that any issues with the AI tools must be promptly reported to the IT Department of the High Court. Previously, the court had overturned reforms to the driving license exams implemented by the State Transport Commissioner, after driving schools challenged the rules as unreasonable and exceeding state jurisdiction.
