SC asks petitioner can it direct legislature to enact faith, gender-neutral legal guidelines

NEW DELHI: The Supreme Court on Friday sought to know from a petitioner if it will probably direct the legislature to make faith and gender-neutral legal guidelines on topics like marriageable age, divorce, adoption, succession, inheritance and alimony.

A bench of Chief Justice D Y Chandrachud and Justices P S Narasimha and J B Pardiwala was listening to a petition searching for a route to the federal government for enacting uniform faith and gender-neutral legal guidelines on all kinds of points. 

“This falls in the legislative domain. Mr Upadhyay, please respond to this issue that it is for legislative intervention and it is for the parliament to do this. Take this as a preliminary issue and address us,” the bench noticed.

Advocate petitioner Ashwini Upadhyay has filed 5 separate petitions searching for route from the Centre to border faith and gender-neutral uniform legal guidelines for divorce, adoption, guardianship, succession, inheritance, upkeep, marriage age, and alimony.

Upadhyay, in August 2020, filed a PIL searching for “uniform grounds of divorce” for all residents, in line with the spirit of the Constitution and worldwide conventions.

He filed one other PIL via advocate Ashwani Kumar Dubey searching for “gender and religion-neutral” uniform grounds of upkeep and alimony for all residents in step with the spirit of the Constitution and worldwide conventions.

In one other PIL, he sought the elimination of anomalies in legal guidelines governing adoption and guardianship and to make them uniform for all residents. He additionally filed a petition searching for the elimination of anomalies in succession and inheritance legal guidelines and making them uniform for all.
