    Highlights

    The petitioners had passed the eligibility test for primary teacher recruitment 2020 at the age of 18. After this, the government completed joint counseling for recruitment of about 18 thousand posts. The High Court passed an order on 13 petitions in the hearing, asking for calculation of age.

The High Court has said in an important order that the minimum age of the candidates should be calculated from January 1, 2024 and they should be given appointment as primary teachers. The division bench of Acting Chief Justice Sanjeev Sachdeva and Justice Vinay Saraf passed this relief order after hearing 13 petitions pending since the year 2022.

    Advocates Rameshwar Singh Thakur and Dinesh Singh Chauhan argued on behalf of the petitioner Kanina Uike, a resident of Mandla, and others. They argued that the petitioner had passed the eligibility test for primary teacher recruitment 2020 at the age of 18 years.

    Later, joint counseling was done by the Commissioner, Directorate of Public Instruction, DPI and Tribal Welfare Department for the recruitment of about 18 thousand posts.

    Issuing new rules, the minimum age limit of the candidate for appointment was fixed at 21 years as on January 1, 2022. Hence, the petitioners were out of the recruitment process.

    On this, the petitioners challenged the constitutional validity of the Directive and Recruitment Rules 2018 issued by DPI.

    During the initial hearing of the petitions, the High Court had passed an interim order making the appointment of the petitioners subject to the final decision on this petition. Ultimately, a final order was passed in favour of the petitioners.
