There has been a change in the rules regarding urban bodies in Madhya Pradesh.

Nagar Palika Second Amendment Ordinance notified, rules have changed for bringing no-confidence motion. Now signatures of three-fourth councillors will be mandatory

As soon as the permission of Governor Mangubhai Patel was received, the Law and Legislative Department notified and made effective the Madhya Pradesh Nagar Palika Second Amendment Ordinance 2024. Let us tell you that after the notification of this ordinance, now no no-confidence motion can be brought against the chairman of Nagar Palika and Nagar Parishad in Madhya Pradesh before three years.
For this, a proposal can be presented only with the signatures of three-fourths of the councillors. This new system has been implemented by the state government by amending section 43a of the Nagar Palika Act 1961 through an ordinance.
Till now, in the state, if two-thirds of councillors expressed no confidence in the president of a Nagar Palika or Nagar Parishad, then a no-confidence motion could be brought after the completion of the two-year period to remove him.
During the assembly and Lok Sabha elections, a large number of councillors left the Congress and joined the BJP. Urban body elections were held in July-August 2022.
The two-year term was coming to an end and there was a fear that no-confidence motions might be moved to remove chairpersons of some bodies.
The government decided to change the system to discourage this. Since the assembly has been recessed, the Urban Development and Housing Department chose the medium of ordinance to amend the Act.
Despite the disagreement of the Senior Secretary Committee, the Cabinet decided to amend the Act and make a provision for bringing a no-confidence motion only after the support of three-fourths of the councillors and completion of a period of three years.
