Relief to SIMS employees from High Court, ban on unilateral discharge from work, permission given to work

Virendra Gahwai, Bilaspur. The High Court has given a big relief to the petitioners in the case of unilateral discharge of nurses and other employees of SIMS. The court has directed them to remain employed in SIMS and mark their attendance, as well as issue a notice to the government and reply.

In fact, SIMS employees Geeta Haldar, Damyanti Kashyap, Sharda Yadav, and V Lakshmi Rao have been serving here since before 2001. At the time of establishment of SIMS in 2001, they were considered to be on deputation to Guru Ghasidas University, while their intention was not asked. In 2006, SIMS was again taken over by the government and the services of the petitioners were again given on deputation to the Director, Medical Education. Since then, the petitioners have been continuously serving in SIMS.

Let us tell you that on 28 June 2024, the SIMS administration suddenly relieved the petitioners from duty and ordered them to take charge in the office of the Chief Medical and Health Officer. On the other hand, the Chief Medical and Health Officer refused to give joining to these employees on the ground that he has not received any such order from the government.

Aggrieved by this order, the employees filed a petition in the High Court. In the petition, they alleged that the SIMS administration has not followed the service law and without knowing their intention, they were ordered to be transferred from one department to another, which is against the fundamental rules and is a violation of the constitutional rights of the employees. The High Court has issued a notice to the government and asked it to respond, directing the petitioners to remain employed in SIMS and mark their attendance.
