MP High Court’s order- Provide the benefit of 20% additional pension on entry at the age of 80 years

Naiduniya, Jabalpur (MP High Court). The High Court passed a relief order in favor of an elderly retired professor. The single bench of Justice Vishal Mishra said in its order that the retired professor should be given the benefit of 20 percent additional pension as soon as he reaches the age of 80.

He was posted as a professor in Jabalpur

Advocate Aditya Sanghi argued on behalf of the petitioner Dr. Laxmi Chand Jain, resident of Jaynagar, Jabalpur. He argued that the petitioner was posted as a professor in the Government Engineering College, Jabalpur. He retired on June 30, 1998. According to the government notification, there is a provision to give 20 percent additional pension to retired employees between the age of 80 to 85 years.

Mention of providing funds between 80 and 85 years

The government provided him the benefit of 20 percent additional pension after completing 80 years. The petitioner is in the last phase of his life. For the benefit of additional pension, 80 years should be calculated from the date on which he completes 79 years and enters the age of 80 years. In the government notification, it has been mentioned to provide the amount of 20 percent between 80 to 85 years.

Order passed to grant pension benefits

The petitioner had entered the age of 80 after completing 79 years. Considering the arguments of the petitioner’s advocate and the government notification, the High Court passed an order to provide the petitioner the benefit of 20 percent additional pension on entering the age of 80. The Higher Education Department of the State Government, Finance Officer Treasury Department and the concerned bank were made non-applicants in the petition.
