The High Court has imposed a fine of Rs 10,000 on Bhopal-elected Congress MLA Arif Masood for not following the previous directive issued on the election petition. A single bench of Justice Vivek Agarwal has directed to deposit the fine amount in the account of NGO Boond within 10 days.

    It also said that in case of non-deposit of the amount, the right to submit a written statement will also end. The next hearing on the case will be on September 6.

    In the Assembly Elections-2023, Dhruv Narayan Singh, the defeated candidate from Bhopal on a BJP ticket, had filed an election petition challenging the election of Arif Masood.

    Senior advocates Ajay Mishra and Pankhuri Vishwakarma argued on behalf of the petitioner. The High Court had issued a notice to Arif Masood on April 8, 2024 and asked him to submit a written statement. Advocate Pankhuri argued that despite 120 days having passed, the statement has not been submitted.

On Thursday, the Commissioner Court passed an order against the accused and said that all three will have to do duty at a crossroad for three hours every Saturday.

    During the restriction period, one will not be able to consume alcohol and other intoxicants. Banganga police had arrested the accused Dharmendra Kuril (Jaihind Nagar), Nishil Khatri (Chhoti Kumharkhadi), Deepanshu Srivastava (Vrindavan Colony) and Jitendra alias Jeetu Rajput (Yadav Nagar) a few days ago. The accused, under the influence of alcohol, threatened people in Vrindavan Colony and vandalized five vehicles.

    Zone-3 DCP Hansraj Singh had presented the case against the accused in the court of Police Commissioner Rakesh Gupta under the Madhya Pradesh State Security Act, 1990. The court, while hearing the police, passed the order on Thursday under Section 3 (1) (a) (g).

    The court has ordered the four accused to be present at Lavkush Chauraha every Saturday from 6 pm to 9 pm. The court also said that the respondents will not consume alcohol and other intoxicants during the restriction period. The concerned police station in-charge will check on the accused from time to time.

    Supreme Court sought reply from MP government

    The matter is about increasing the OBC reservation from 14 to 27 percent by amending the MP Public Service Reservation Act by the state government in the year 2019. At the same time, the Supreme Court has sought a reply from the Madhya Pradesh government on two petitions challenging the 87:13 percent formula.

    A petition was filed in the Supreme Court by the state government to transfer the cases related to OBC reservation. During the hearing on this, Solicitor General Tushar Mehta presented his side on behalf of the MP government. Advocate Aditya Sanghi argued on behalf of the unreserved category that due to the pending transfer petition in the Supreme Court, these cases are not being heard in the High Court.

    Many appointments are not being made by the MP Public Service Commission due to pending cases in the court. On this, the Supreme Court directed to immediately transfer all the 85 petitions pending in the MP High Court.

    Now OBC cases are likely to be heard at a relatively faster pace in the Supreme Court. The Supreme Court will now decide how much reservation to give to OBCs. The decision to give 27 percent reservation to OBCs was first challenged in the High Court in the year 2019. After this, many petitions were filed. Some of these were filed in favor of OBC reservation and some against it. For the last one year, these cases have not been heard speedily.
